The Transition Interpreting Justice from Thurgood Marshall to Clarence Thomas
Free Download Daniel Kiel, "The Transition: Interpreting Justice from Thurgood Marshall to Clarence Thomas"
English | ISBN: 150363065X | 2023 | 376 pages | PDF | 2 MB
Every Supreme Court transition presents an opportunity for a shift in the balance of the third branch of American government, but the replacement of Thurgood Marshall with Clarence Thomas in 1991 proved particularly momentous. Not only did it shift the ideological balance on the Court; it was inextricably entangled with the persistent American dilemma of race. In The Transition, this most significant transition is explored through the lives and writings of the first two African American justices on Court, touching on the lasting consequences for understandings of American citizenship as well as the central currents of Black political thought over the past century.

Social Justice and Individual Ethics in an Open Society Equality, Responsibility, and Incentives
Free Download Frank Vandenbroucke, "Social Justice and Individual Ethics in an Open Society: Equality, Responsibility, and Incentives"
English | 2001 | pages: 313 | ISBN: 3540416366 | PDF | 19,4 mb
Can the need for incentives justify inequality? Starting from this question, Frank Vandenbroucke examines a conception of justice in which both equality and responsibility are involved. In the first part of the inquiry, which explores the implementation of that conception of justice, the justification of incentives assumes that agents make personal choices based only upon their own interests. The second part of the book challenges the idea that a normative conception of distributive justice can be based on that traditional assumption, i.e. that personal choices are not the subject matter of justice. Thus, Vandenbroucke questions the Rawlsian idea that the primary subject of a theory of justice is the basic structure of society, and not the individual conduct of its citizens. For a society to be really just, the ethos of individual conduct has to serve justice. Non-mathematical readers can skip the formal model proposed in Chapter 3 and understand the rest of the book.

Free Download Edward H. Levi, "Restoring Justice: The Speeches of Attorney General Edward H. Levi"
English | ISBN: 022604131X | 2013 | 248 pages | PDF | 996 KB
In the wake of Watergate, Gerald Ford appointed eminent lawyer and scholar Edward H. Levi to the post of attorney general-and thus gave him the onerous task of restoring legitimacy to a discredited Department of Justice. Levi was famously fair-minded and free of political baggage, and his inspired addresses during this tumultuous time were critical to rebuilding national trust. They reassured a tense and troubled nation that the Department of Justice would act in accordance with the principles underlying its name, operating as a nonpartisan organization under the strict rule of law.

Literature's Critique, Subversion, and Transformation of Justice
Free Download Ruben Moi, "Literature's Critique, Subversion, and Transformation of Justice"
English | ISBN: 1666952583 | 2024 | 222 pages | EPUB, PDF | 1059 KB + 2 MB
Literature is an institution per se, as is justice, and these two institutions enact each other in complex ways. Justice appears in many forms from divine right and religious ordainment to metaphysical imperative and natural law, to national jurisdiction, social order, human rights, and civil disobedience. What is just and right has varied in time and place, in war and peace. A sense of justice appears inextricable from human concerns of ethics and morals. Literature includes a vast range of writing from holy texts to banned books. Parts of literature, particularly in the past, have laid down the law. In more recent history, literature has gradually assumed radical roles of critique, subversion, and transformation of the existing law and order, in contents, themes, language, and form. Literature's Critique, Subversion, and Transformation of Justice
