Feminist Judgments Rewritten Employment Discrimination Opinions
Free Download Ann C. McGinley, "Feminist Judgments: Rewritten Employment Discrimination Opinions "
English | ISBN: 1108493173 | 2020 | 504 pages | PDF | 3 MB
How would feminist perspectives and analytical methods change the interpretation of employment discrimination law? Would the conscious use of feminist perspectives make a difference? This volume shows the difference feminist analysis can make to the interpretation of employment discrimination statutes. This book brings together a group of scholars and lawyers to rewrite fifteen employment discrimination decisions in which a feminist analysis would have changed the outcome or the courts' reasoning. It demonstrates that use of feminist perspectives and methodologies, if adopted by the courts, would have made a significant difference in employment discrimination law, leading to a fairer and more egalitarian workplace, and a more prosperous society.

Feminist Judgments Health Law Rewritten
Free Download Seema Mohapatra, "Feminist Judgments: Health Law Rewritten "
English | ISBN: 1108495095 | 2022 | 400 pages | PDF | 2 MB
This volume provides an alternate history of health law by rewriting key judicial opinions from a feminist perspective. Each chapter includes a rewritten opinion penned by a leading scholar relying exclusively on court precedents and scientific understanding available at the time of the original decision accompanied by commentary from an expert placing the case in historical context and explaining how the feminist judgment might have shaped a different path for subsequent developments. It provides a map of the health law field-where paternalism, individualism, gender stereotypes, and tensions over the public-private divide shape decisions about informed consent, medical and nursing malpractice, the relationships among health care professionals and the institutions where they work, end-of-life care, reproductive health care, biomedical research, ownership of human tissues and cells, the influence of religious directives on health care standards, health care discrimination, long-term care, private health insurance, Medicaid coverage, the Affordable Care Act, and more.

Free Download Rachel Rebouché, "Feminist Judgments: Family Law Opinions Rewritten "
English | ISBN: 1108471706 | 2020 | 444 pages | PDF | 2 MB
This book provides new, feminist perspectives on famous family law cases that span generations. The chapters take court decisions and rewrite them with feminist ideas in mind. Each rewritten opinion is penned by a leading scholar who relied only on materials available at the time of the original decision. The decisions address topics such as the criminalization of polygamy, intimate partner violence as a ground for asylum, the legality of gestational surrogacy, the rights of cohabitants, discrimination against transgender parents, immigration rules governing non-citizen parents, and child welfare and child support systems, among others. Each opinion is accompanied by a commentary that explains the original opinion as well as its contemporary relevance, and each commentary also is authored by a respected scholar. The combination of a rewritten opinion and its commentary provides an in-depth examination of the most important topics in family law.

Exploring Interconnectedness Constructions of European and National Identities in Educational Media
Free Download Exploring Interconnectedness: Constructions of European and National Identities in Educational Media
English | 2023 | ISBN: 3031139593 | 472 Pages | PDF EPUB (True) | 42 MB
This volume explores the socio-cultural and media background of a critical and ongoing political challenge: the complex entanglement between European integration and strong national agendas in the context of globalisation. It does so using educational media - both textbooks and digital media - as sites of cultural contestation to enquire into the intricate relationships around national and European identities and aspects of students' knowledge and reception. Using a variety of methods and technologies, the chapters analyse identity constructions present in educational media discourses, embedded as they are in their national and European contexts and as both the catalysts and products of their time. The book is a study of the post-digital condition in an educational context, exploring the potential of digital humanities and linguistic approaches for educational media research and employing methods such as eye-tracking or concept maps.

Expert Ignorance The Law and Politics of Rule of Law Reform
Free Download Expert Ignorance: The Law and Politics of Rule of Law Reform
English | 2023 | ISBN: 100928472X | 288 Pages | PDF | 3 MB
Today, a transnational constellation of 'rule of law' experts advise on 'good' legal systems to countries in the Global South. Yet these experts often claim that the 'rule of law' is nearly impossible to define, and they frequently point to the limits of their own expertise. In this innovative book, Deval Desai identifies this form of expertise as 'expert ignorance'. Adopting an interdisciplinary approach, Desai draws on insights from legal theory, sociology, development studies, and performance studies to explore how this paradoxical form of expertise works in practice. With a range of illustrative cases that span both global and local perspectives, this book considers the impact of expert ignorance on the rule of law and on expert governance more broadly. Contributing to the study of transnational law, governance, and expertise, Desai demonstrates the enduring power of proclaiming what one does not know. This title is available as Open Access on Cambridge Core.

Ever Not Quite Pluralism(s) in William James and Contemporary Psychology
Free Download Ever Not Quite: Pluralism(s) in William James and Contemporary Psychology
English | 2023 | ISBN: 1108845029 | 197 Pages | PDF | 1.2 MB
William James made many references to pluralism throughout his career. Interestingly, many contemporary psychologists also discuss pluralism and indeed call for pluralism as a corrective to the discipline's philosophical and methodological foundations. Yet, pluralism and the purposes to which it is applied are understood in a variety of ways, and the relation of contemporary pluralism to the pluralism(s) of William James is uncertain. This book offers conceptual clarification in both contexts, first distinguishing diverse senses of pluralism in psychology and then systematically examining different forms of pluralism across the writings of James. A comparison of meanings and analysis of implications follows, aimed at illuminating what is at stake in ongoing calls for pluralism in psychology.

Environmental Hydrology
Free Download Andy D. Ward, Stanley W. Trimble, Suzette R. Burckhard, "Environmental Hydrology"
English | 2015 | pages: 687 | ISBN: 1466589418 | PDF | 107,4 mb
The late Professor Reds Wolman in his Foreword to the award-winning second edition said, "This is not your ordinary textbook. Environmental Hydrology is indeed a textbook, but five elements often found separately combine here in one text to make it different. It is eclectic, practical, in places a handbook, a guide to fieldwork, engagingly personal and occasionally opinionated. ... and, perhaps most engaging to me, in places the authors offer personal views as well as more strongly worded opinions. The former often relate to evaluation of alternative approaches, or formulations, of specific solutions to specific hydrologic problems."
