Der volkswirtschaftlichen Bedeutung des Kreditsektors wird in zahlreichen Industrieländern durch eine explizite Bankenaufsicht Rechnung getragen, nicht selten ergänzt durch umfa- reiche Einzelvorschriften analog zum Gesetz über das Kreditwesen (KWG) in Deutschland. Zudem sind auch die institutionellen Akteure auf den nationalen oder internationalen Kred- märkten nicht homogen, sondern unterscheiden sich z.B. durch ihre spezifische Eigentüm- struktur. Dies gilt im Besonderen für die öffentlich-rechtlichen Kreditinstitute in Deutschland. Ihre im internationalen Vergleich außergewöhnliche Rechtsform führt regelmäßig zu Fe- interpretationen ihrer Stellung auf dem inländischen Bankenmarkt. Nicht selten wird das Regionalprinzip der deutschen Sparkassen mit einer monopolähnlichen Marktposition glei- gesetzt, ohne zu berücksichtigen, dass alle einschlägigen Vorschriften von Kreditwesen- und Kartellgesetz auch für die öffentlich-rechtlichen Institute gelten.
