Wechselwirkungen zwischen dem Irrtumsrecht und den Regeln über anfängliche Leistungshindernisse bestehen in vielfacher Form, da der Schuldner im Falle der anfänglichen Unmöglichkeit zumeist über seine Fähigkeit zur Leistungserbringung irrt und dieser Irrtum nicht selten als Eigenschaftsirrtum nach § 119 Abs. 2 BGB zu qualifizieren ist.Ziel der Arbeit ist es, die Auswirkungen dieser Überschneidungen in Hinblick auf die Anfechtungsmöglichkeit des Schuldners sowie seine Haftung zu untersuchen. Das Ergebnis kann in den beiden folgenden Kernthesen zusammengefasst werden:Im Falle eines anfänglichen Leistungshindernisses darf der Schuldner, der zugleich einem Irrtum nach § 119 Abs. 2 BGB unterliegt, von seinem Anfechtungsrecht aufgrund einer teleologischen Reduktion der §§ 119 ff. BGB keinen Gebrauch machen, wenn das Gesetz aufgrund der Unmöglichkeit Haftungsanordnungen zugunsten des Gläubigers statuiert. Der Schuldner darf sich mittels der Anfechtung nicht diesen speziellen Haftungsfolgen entziehen, ohne dass es darauf ankommt, ob der Gläubiger von den Rechten, die sich aus der Unmöglichkeit ergeben, Gebrauch machen will oder nicht.Der Schuldner ist bei einem anfänglichen nicht zu vertretenden Leistungshindernis nicht zum Ersatz des Vertrauensschadens analog § 122 BGB verpflichtet. Für eine derartige Analogie fehlt es bereits an einer planwidrigen Regelungslücke, da sich die Regelungen des Leistungsstörungsrechts als abgeschlossenes System erweisen, das nicht durch eine verschuldensunabhängige Haftung für anfängliche nicht zu vertretende Leistungshindernisse erweitert werden kann. Darüber hinaus besteht auch keine vergleichbare Interessenlage, da der Gläubiger im Falle eines anfänglichen Leistungshindernisses nicht die gleiche Schutzbedürftigkeit und Schutzwürdigkeit aufweist wie der Empfänger einer irrtümlich abgegebenen Willenserklärung.
