Ziel dieser Arbeit ist es herauszufinden, inwieweit sich bereits derartige universelle private Normenordnungen gebildet haben und ob diese als transnationales Recht bezeichnet werden können.Nils Ipsen untersucht vor dem Hintergrund der rechtstheoretischen - insbesondere autopoietischen - Geltungsbegründungen drei Bereiche, in denen sich derartige Normenordnungen herausgebildet haben sollen: der internationale Handel mit der lex mercatoria, das Internet mit der lex informatica und der internationale Sport mit der lex sportiva. Der Autor kommt zu dem Ergebnis, dass nur die Normenordnungen praktische Bedeutung erlangen können, die von einer sozialmächtigen Institution unterstützt werden. Aber selbst diese werden auf vielfältige Weise vom staatlichen Recht beeinflusst, so dass das staatliche Recht den privaten Normenordnungen über- und nicht gleichgeordnet ist. Letztere können deswegen nur dauerhaft existieren, wenn sie sich an den Grundsätzen der Rechtsstaatlichkeit orientieren.
