Dieser bisher kaum thematisierten Problematik geht Christian Reuther am Beispiel von Jugendarrest und Jugendstrafe nach. Er untersucht detailliert, wie Verhängung und Vollzug dieser Sanktionen das Grundrecht der Eltern beschränken und welche Rechtfertigungsmöglichkeiten es hierfür gibt. Dabei stellt der Autor fest, dass weder im staatlichen Wächteramt aus Art. 6 Abs. 2 S. 3 GG noch in der staatlichen Trennungsbefugnis gemäß Art. 6 Abs. 3 GG eine verfassungsrechtliche Rechtfertigung erblickt werden können. Der Verfasser kommt so zu dem Ergebnis, dass nicht der im Jugendstrafrecht vermeintlich vorherrschende Erziehungsgedanke den Anordnungszweck von Jugendstrafe und Jugendarrest darstellt, sondern die Strafe selbst.Hiervon ausgehend untersucht Christian Reuther die rechtshistorische Herkunft der staatlichen Strafgewalt, um sie sodann verfassungsrechtlich zu verankern. Neben den rechtlichen Ausführungen werden dabei auch Ursachen von Jugendkriminalität und Auswirkungen einer Inhaftierung eingehend behandelt.Im Ergebnis sind staatliche Strafgewalt und die Rechte der Eltern bzw. Erziehungsberechtigten im Wege der praktischen Konkordanz in einen gerechten Ausgleich zu bringen. Vor diesem Hintergrund untersucht der Autor, wie dies der neueren Gesetzgebung zum Jugendstrafrecht gelungen ist. Insbesondere bezüglich der seit dem 1.
