Dieser steht im Widerspruch zum so genannten Örtlichkeitsprinzip, demzufolge das Geschäftsgebiet kommunaler Unternehmen auf die sie tragenden Gemeinden begrenzt sein soll.Carolina Scheps untersucht die rechtlichen Implikationen dieses Prinzips. Nachdem sie die Grundlagen des Örtlichkeitsprinzips als Bestandteil der Verfassungsbindungen öffentlicher Gewalt aufarbeitet, widmet sie sich der Reichweite des räumlichen Wirkungskreises kommunaler Unternehmen. Sie kommt zu dem Ergebnis, dass die Kompetenzzuweisung des Art. 28 Abs. 2 Satz 1 GG eine Leistungserbringung an Empfänger außerhalb des eigenen Gemeindegebietes nicht mehr deckt. Eine Ausnahme besteht nur, sofern die Betätigung allein der Auslastung bestehender Unternehmenskapazitäten dient. Auch eine solche kapazitätsauslastende Annextätigkeit ist jedoch nicht unbeschränkt zulässig. Sie berechtigt die kommunalen Unternehmen insbesondere nicht zum Eintritt in ein Wettbewerbsverhältnis mit den kommunalen Unternehmen der von dem Gebietsübertritt betroffenen Gemeinden. Ausgehend von diesem nationalrechtlichen Ergebnis, überprüft die Autorin das Örtlichkeitsprinzip auf seine Vereinbarkeit mit dem EG-Recht. Sie kommt zu dem Schluss, dass dieses dem Örtlichkeitsprinzip grundsätzlich nicht entgegensteht. Die Arbeit wird abgeschlossen durch die Darstellung rechtlich zulässiger Möglichkeiten einer Ausweitung des Wirkungskreises kommunaler Unternehmen, insbesondere im Rahmen einer interkommunalen Zusammenarbeit. |
