Dies gilt vor allem für solche Vereine, in denen die Mitglieder in besonderem Maße auf die Mitgliedschaft angewiesen sind. Für sie hat der Bundesgerichtshof mit seiner Entscheidung vom 3. April 2000 (BGHZ 144, 146) die Einführung einer Schiedsklausel von der Zustimmung des einzelnen Mitglieds abhängig gemacht.Richtigerweise kann eine Schiedsklausel aber auch in solchen Vereinen das einzelne Mitglied gegen seinen Willen binden, wenn sie bestimmten inhaltlichen Anforderungen genügt. Das folgt aus den vereinsrechtlichen Mechanismen, die der Geltung einer solchen Satzungsregelung gegenüber den Mitgliedern zugrunde liegen. Obwohl grundrechtliche Positionen jedes einzelnen Mitglieds betroffen sind, kann daher auch im sozial mächtigen Verein eine Schiedsklausel durch satzungsändernden Mehrheitsbeschluß geschaffen werden. An einer Vielzahl möglicher Regelungen von der Bestellung der Schiedsrichter über das Verfahren vor dem Schiedsgericht bis zum Aufhebungsverfahren wird untersucht, welche Folgen dies für die Ausgestaltung einer Schiedsklausel im sozial mächtigen Verein hat.Ausgezeichnet mit dem Förderpreis 2003/04 der Deutschen Institution für Schiedsgerichtsbarkeit e.
