Dabei bezieht sie sich auf empirische Erkenntnisse, die sie insbesondere anhand von Beobachtungen sog. Diversionsgespräche sowie durch Interviews mit Verfahrensbeteiligten gewinnen konnte. Auf dieser rechtstatsächlichen Grundlage untersucht sie die Richtlinie auf ihre Vereinbarkeit mit den einfachgesetzlichen und verfassungsrechtlichen Regelungen.Ingke Goeckenjan kommt zu dem Ergebnis, dass das Berliner Diversionsverfahren an gravierenden rechtlichen und rechtstatsächlichen Mängeln leidet. So weist sie u. a. nach, dass die Weichen stellende Rolle der Polizei innerhalb des Verfahrens die gesetzlich verankerte Entscheidungskompetenz der Staatsanwaltschaft unzulässig einschränkt. Aus diesen Erkenntnissen leitet die Verfasserin schließlich konkrete Empfehlungen für künftige Diversionsregelungen ab.
