Against such a backdrop, the democratic mechanisms of representation, on the one hand, and the traditional civil law dualistic paths of litigation, on the other hand, appear ineffective in enforcing rights, especially fundamental ones. The present research, theoretical and empirical, aims to evaluate the role of Italian class actions (also referred to, in the European context, as collective or representative actions) as a means of overcoming such challenges and ensuring effective access to justice. Adopting an innovative constitutional-law standpoint, it stems from the recent EU Directive 2020/1828 on representative actions for the protection of the collective interests of consumers, as well as the related national reforms, some of which - like the Italian one - are innovatively trans-substantive. From this, the book analyses, in a broader comparative lens, the constitutional foundations of collective enforcement (as opposed to individual litigation), the specific use of collective proceedings to enforce fundamental rights (rather than mere consumer ones - hence, the originality in the current scholarship context) and the potential drawbacks in light of possible abuse and fair trial guarantees. The topicality of the study is given by the currently developing case law on the matter in all EU Member States, especially in Italy, as well as by the numerous discussions on how to best implement such a tool in a strategic litigation perspective, while upholding essential due process guarantees. The analysis is interdisciplinary, as initially it draws from sociological and socio-legal insights, subsequently theoretically developed and assessed through the aid of case studies. It is also comparative, towards other jurisdictions' implementation of class actions and towards other more traditional European paths of fundamental rights' enforcement (e.g. constitutional review and ECtHR applications). The foundational lens, nonetheless, is a constitutional and legal one, since, on the one hand, it does so against the backdrop of the principles of fair trial and effective protection, enshrined under Articles 2, 24 and 111 It. Const., 6 and 13 ECHR, 47 CFREU, and 2 and 19 TEU, as developed by national and supranational Apex courts. ![]() Free Download Margaretta Frederick Watson, "Collecting the Pre-Raphaelites" English | 2018 | ISBN: 1138312991, 1138313025 | EPUB | pages: 240 | 5.4 mb First published in 1997, and written by leading scholars of the day , these fifteen essays examine aspects of the reception and collecting of Pre-Raphaelite Art, the social and cultural context in which the work was favoured and acquired. Two major collections provide the focus for the investigation: that of the Birmingham city Museums and Art Gallery in the United Kingdom, and that of the American Samuel Bancroft Jr, now part of the Delaware Art Museum. The study of these two collections both formed in the late 1890', places Pre-Raphaelite Art at nexus of contemporary cultural issues that touched the lives of both the city council, intent on establishing a public gallery of national importance, and a wealthy American businessman, indulging a private passion for the work of these artists. The contributors approach the issue in a variety of ways, These include the study of the ambitions and self-perception of collectors of the period, an analysis of the impact of John Ruskin's campaign to establish Pre-Raphaelite painting as the 'Art of England' , and its impact on notions of civic and national identity ; the examination of individual painting in relation to such issues as the portrayal of women, the nude and of religious subjects ; and the study of the Victorian preoccupation with Renaissance Italy and the attempt by Ruskin, Charles Fairfax Murray , advisor to the two collections, and the Grosvenor Gallery, to proclaim the Pre-Raphaelite artists as the true inheritors of the 'genius' of Renaissance Italian artists. These essays were first presented at a symposium held at the Delaware Art Museum during the exhibition there of the paintings of Birmingham City Museums and Art Gallery. ![]() Free Download Code with AI: Leveraging ChatGPT for jаvascript by Laurence Lars Svekis English | March 2, 2025 | ISBN: N/A | ASIN: B0DZ1QFJK1 | 180 pages | EPUB | 1.39 Mb Unlock the power of AI in jаvascript development with Code with AI: Leveraging ChatGPT for jаvascript.
