Dieser Kritik geht der Autor nach.Hierbei stellt Michael Güntner zunächst beide Bewerbertypen idealtypisch gegenüber und beleuchtet anschließend ihre gesetzlichen Voraussetzungen, Erscheinungsformen und Verwendungsarten. Sodann behandelt er das Laufbahnprinzip als verfassungsrechtliche Grundlage des Laufbahnbewerbers, dessen Herkommen, Inhalt, Zweck und Verhältnis zu anderen hergebrachten Grundsätzen des Berufsbeamtentums. Die verfassungsrechtliche Untersuchung des Außenseiters führt zu dem Befund, daß dieser selbst verfassungsrechtlich nicht abgesichert ist, sondern eine legitimationsbedürftige Ausnahme vom Regeltypus des Laufbahnbewerbers darstellt.Der Verfasser schließt mit rechtspolitischen Vorschlägen zur Neufassung der Vorschriften über den "anderen Bewerber". |
