Anlass sind gesetzliche Neuerungen im Ausländerrecht. Der Gesetzgeber verschärfte die Regelungen zur Ausweisung und Abschiebung durch Einführung der Abschiebungsanordnung sowie Erweiterungen der Abschiebungshaft. Die Dissertation greift das Spannungsverhältnis zwischen dieser Form der Abwehr terroristischer Gefahren und rechtsstaatlichen Grundsätzen auf und zieht in kritischer Analyse einen Vergleich mit anderen Haftarten.Den Ausgangspunkt der Untersuchung bilden die bei der Abschiebungsanordnung neu eingeführten Begriffe der "terroristischen Gefahr" sowie der "auf Tatsachen gestützten Prognose". Deren notwendig restriktive Auslegung bewirkt einen minimalen Anwendungsbereich. Bei der Analyse der Abschiebungsanordnung werden in der Ausgestaltung des Verfahrens eine Reihe von rechtsstaatlich bedenklichen Elementen offenbar. Zwei Regelungen stehen dabei im Mittelpunkt. Zum einen wirft die Verwaltungskompetenz des Bundes kompetenzrechtliche Fragen auf. Zum anderen bedingen diverse verfahrensverkürzende Besonderheiten eine Verletzung des Art. 19 IV GG. Als eine der Rechtsfolgen der Abschiebungsanordnung rückt auch die Abschiebungshaft wieder in den Fokus verfassungsrechtlicher Erwägungen. Gegen deren gesetzliche Ausgestaltung erhebt die Verfasserin grundsätzliche Bedenken.Der Vollzug der Abschiebungshaft in Einrichtungen der Innenverwaltung widerspreche ohne eine gesetzliche Grundlage dem Grundsatz des Vorbehalts des Gesetzes. Erfolgt die Abschiebungshaft hingegen in Justizvollzugsanstalten, so erforderten die besonderen Umstände sowie der Haftzweck eine eigene gesetzliche Vollzugsregelung. Die gesetzlichen Höchstfristen der Abschiebungshaft seien im Hinblick auf ihren Ausnahmecharakter zu lang. Die Dauer habe sich an der Praxis anderer präventiver Haftarten zu orientieren und sei grundsätzlich auf drei Monate zu beschränken.
