Im Anschluss analysiert sie die Voraussetzungen für die Geltung der unterverfassungsrechtlichen Normen in der AWZ. Dieser Teil der Untersuchung schließt mit dem Ergebnis, dass Normen des einfachen Rechts nicht ipso iure gelten, sondern vielmehr einer ausdrücklichen Erstreckungsanordnung bedürfen. Im letzten Abschnitt widmet sich Risch der Bedeutung von Art. 14 und 12 GG sowie der Frage, ob die zivilrechtliche Eigentumsordnung in der AWZ gilt und welche Konsequenzen sich aus der Nichtgeltung für den Anlagenbetreiber und den Gesetzgeber ergeben.
