Als zentrale Ergebnisse der Analyse wäre zu betonen: Die Wahl dieser Solidarordnung verlangt die Monopolbildung. Der Lastenausgleich zwischen den Berufsgenossenschaften ist in einem System gewinnorientierter privater Versicherungsanbieter durch Privatisierung im Sinne der Marktöffnung nicht möglich und würde so das finanzielle Gleichgewicht des berufsgenossenschaftlichen Systems untergraben. Derartige Marktöffnungen wären mit Risikoselektionen verbunden, die die Konstruktionslogik des Systems nicht nur gefährden, sondern erodieren würden. Hierbei entstehen Probleme der Versicherbarkeit schlechter Risiken. Private Versicherungen sind ferner nicht billiger, werfen höhere Verwaltungskosten auf, und zusätzlich treten neue Transaktionskosten im Vergleich zum berufsgenossenschaftlichen Monopol auf, die volkswirtschaftlich Wohlfahrtsverluste darstellen. Es ist eine Fehleinschätzung, a priori zu behaupten, privatwirtschaftliche Arrangements seien effizienter als öffentliche Monopole.
