Im Anschluss erläutert sie Begriffe und Aufbau des § 406 BGB und arbeitet im Einzelnen die verschiedenen Fallgruppen des zweiten Halbsatzes der Norm heraus.Der Schwerpunkt der Arbeit liegt auf der in Rechtsprechung und Literatur umstrittenen Frage, ob bei einer Vorauszession der Forderung die hierüber gegebene Kenntnis des Schuldners einer Kenntnis der Abtretung i. S. d. § 406 BGB gleichzustellen ist. Nach Darstellung des Diskussionsstandes beleuchtet Carola Reichold den Normzweck und die systematische Einordnung dieser Schuldnerschutzvorschrift. Sie arbeitet heraus, dass der Gedanke des Vertrauensschutzes für die vorliegende Fragestellung maßgebliche Bedeutung hat.
