The guiding principle of behavioral sociology is that law behaves in correspondence to social space, while the guiding principle of law and economics is that individuals behave rationally. Behavioral economics has challenged the principle of the rational actor and, consequently, has also challenged the desire for scientific purity in law and economics. Peter Mascini defends a two-fold thesis: first, that the purification of sociology proposed by behavioral sociology is a blind alley that can only be exited by allowing impurity. Second, that the behavioral economics movement has offered law and economics an opportunity to reinvigorate by embracing impurity. The combination of the two parts of his thesis lead him to the claim that we need less purity in the behavioral study of law rather than more. He ends his lecture by stating that the introduction of impurity that has been started by behavioral economics needs to be extended in several respects. He proposes to replace the behavioral study of law by an approach that not only takes empirical research seriously, but also adopts a modest attitude by surrendering the ambition to come up with universally applicable predictions and by taking seriously meaningful behavior. (Series: Erasmus Law Lectures, Vol. 41) [Subject: Behavioral Sociology, Law and Economics, Behavioral Economics, Private Law] ![]() Free Download Law Without Lawyers, Justice Without Courts : On Traditional Chinese Mediation By Bee Chen Goh 2002 | 162 Pages | ISBN: 184014744X | EPUB | 1 MB The Chinese have, since ancient times, professed a non-litigious outlook. Similarly, their preference for mediation has fascinated the West for centuries. Mediation has been popularized by the Chinese who subscribe to the Confucian notions of harmony and compromise. It has been perpetuated in the People's Republic of China and by the overseas Chinese communities elsewhere, such as in Malaysia and Taiwan. Seen as the chief contributing factor in their litigation-averse nature, as well as the reason behind the significant role given to traditional mediation, this compelling book traces the cultural tradition of the Chinese. It uses rural Chinese Malaysians as illustrative examples and offers new insights into the nature of mediation East and West. It is an important reference and essential resource for anyone keen to learn about traditional Chinese concepts of law, justice and dispute settlement. Equally, it makes a unique contribution to the existing ADR literature by undertaking a socio-legal study on traditional Chinese mediation. ![]() Free Download Latinx Literature Unbound : Undoing Ethnic Expectation By Ralph E. Rodriguez 2018 | 193 Pages | ISBN: 0823279243 | EPUB | 1 MB Since the 1990s, there has been unparalleled growth in the literary output from an ever more diverse group of Latina/o writers. The extant criticism, however, has yet to catch up with the diversity of writers we label Latina/o and the range of themes about which they write. Little sustained scholarly attention has been paid, moreover, to the very category-Latina/o-under which we group this literature. Latina/o Literature Unbound, thus, begins with a fundamental question "What does it mean to label a work of literature or an entire corpus of literature Latina/o?" From this question a host of others spin out: What does that grouping allow us to see, predispose us to see, and preclude us from seeing? If the grouping-which brings together a heterogeneous collection of people and groups under a seemingly homogeneous label-tells us something meaningful, is there a poetics we can develop that would facilitate our analysis of this literature? In answering these questions, Latina/o Literature Unbound seeks to unbind Latina/o literature from taken-for-granted critical assumptions about identity and theme. It argues that there may be more salubrious taxonomies than Latina/o for organizing and analyzing this literature. Following a neo-formalist interpretive model that privileges reading as a temporal, meaning-making event, the book argues that genre may be a more durable category for analyzing this literature. Finally, Latina/o Literature Unbound suggests some ways in which we might want to proceed as we move forward with future studies of the writing we have come to identify as Latina/o. ![]() Free Download Language across Languages : New Perspectives on Translation By Emanuele Miola; Paolo Ramat 2015 | 193 Pages | ISBN: 1443877115 | PDF | 1 MB Since the first written documents in the history of mankind (produced at the end of the 4th millennium BC), translation has always played a pivotal role in human societies. Translators were needed whenever the need for contact between different-speaking communities arose, such as for the purposes of communication, commerce, and declarations of war, or peace. Translation is even more important in today's world. Globalization has brought the nations of the Earth closer, to the extent that books, movies and television programs released or aired far away in the world are just a click of the mouse away. However, such cultural products still have to be translated in order to be enjoyed by a wider audience. In international relations, diplomacies work very much on the basis of what is said and written, meaning that official documents and political charts need to be correctly and precisely translated. Hi-tech devices, such as tablets and smartphones, have their software translated into an increasing number of languages, in order to be accessible to a larger number of people. The challenging issues that arise for translation studies from these socio-cultural changes in Western Europe and all over the world are tackled in this volume according to two intertwined viewpoints: From a strictly linguistic perspective, typological differences between genetically unrelated languages challenge linguists in gaining an overall understanding of what language really is: how can linguistic categories, be they verbal, nominal or pertaining to other domains of the grammar, be defined? How are they shaped in syntax? From the point of view of anthropological linguistics, on the other hand, the cross-linguistic differences that come to the fore illustrate that translating - as well as language itself - is one of the basic cognitive strategies of the human mind. ![]() Free Download Language Contact in Sanandaj: A Study of the Impact of Iranian on Neo-Aramaic by Geoffrey Khan, Masoud Mohammadirad English | November 6, 2023 | ISBN: 3111205789 | 614 pages | MOBI | 2.10 Mb This book is a detailed study of contact-induced change in the Neo-Aramaic dialect of the Jews of Sanandaj, a town in western Iran. Since its foundation in early 17th century, the city has been home to a significant Jewish community. The Jewish Neo-Aramaic dialect of the town displays different historical layers of contact with various Iranian languages over the course of many centuries. The Iranian languages in question are Gorani, Kurdish, and Persian. Among these, Gorani has had a particularly deep impact on Jewish Neo-Aramaic, whereas the impact of Kurdish, and especially Persian, remains superficial. Jewish Neo-Aramaic records a history of language shift from Gorani to Kurdish in the region. The book offers insights into contact-induced change in social contexts in which a language is maintained as a demarcation of communal identity in a multilingual setting. ![]() Free Download Langston Hughes and the *Chicago Defender*: Essays on Race, Politics, and Culture, 1942-62 By Langston Hughes 2022 | 179 Pages | ISBN: 0252064747 | EPUB | 1 MB Langston Hughes is well known as a poet, playwright, novelist, social activist, communist sympathizer, and brilliant member of the Harlem Renaissance. He has been referred to as the "Dean of Black Letters" and the "poet low-rate of Harlem." But it was as a columnist for the famous African-American newspaper the Chicago Defender that Hughes chronicled the hopes and despair of his people. For twenty years, he wrote forcefully about international race relations, Jim Crow, the South, white supremacy, imperialism and fascism, segregation in the armed forces, the Soviet Union and communism, and African-American art and culture. None of the racial hypocrisies of American life escaped his searing, ironic prose. This is the first collection of Hughes's nonfiction journalistic writings. For readers new to Hughes, it is an excellent introduction; for those familiar with him, it gives new insights into his poems and fiction. ![]() Free Download Langraph for Developers: Unlocking Advanced LLM Capabilities by Harvey Reed English | October 26, 2024 | ISBN: N/A | ASIN: B0DL4R873Y | 271 pages | EPUB | 0.98 Mb Langraph is a revolutionary tool for integrating Large Language Models (LLMs) into real-world applications.
