Diese geisteswissenschaftliche Betrachtung kulturell ererbter Vorstellungen im Recht zielt sowohl auf ihr besseres Verständnis wie auf ein bewussteres Verhalten zur kulturellen Tradition bei der Interpretation.Hegel hat seine These, dass es in Europa "keine Salomos geben kann", nicht mit einem Hinweis auf kulturelle Unterschiede begründet. Daraus folgt die Frage, wann und warum der jeweilige historische Kontext des Rechts ausdrücklich als "Kultur" begriffen und dem Recht als eigenständige Größe gegenübergestellt wurde. In diesem Vortrag zeigt der Autor, dass das Begriffspaar "Recht und Kultur" ursprünglich das Verhältnis von Recht und Wirtschaft meinte, bevor die "Kulturphilosophie" des ausgehenden 19. Jahrhunderts als Wissenschaftstheorie (auch) der Rechtswissenschaft Karriere machte.In der dritten Rede wird das Schlagwort von der Wiederkehr des Religiösen in der säkularisierten Gesellschaft aufgegriffen. Hasso Hofmann sucht den Ort der Religion, dieses Kerns von Kultur, in der weltanschaulich neutralen Verfassungsordnung näher zu bestimmen.

Kelsen regarded constitutional adjudication as a logical consequence of constitutionalism. Schmitt rejected it because he had a different guardian of the constitution in mind. In the second half of the 20th century, Kelsen's view prevailed. Constitutional courts were established all over the world. In the beginning of the 21st century, criticism of judicial review gains ground. Ultimately, it is always about the relationship between law and politics, so as well in this essay.
