Unter den Bedingungen grundrechtlicher Freiheit muß jedermann ein bestimmtes Quantum an lästigem zwischenmenschlichen Verhalten ertragen, an Unmoral und Geschmacklosigkeit, soweit sie nicht in Verletzung von Rechtsgütern umschlagen. Als schutzwürdiges Rechtsgut gilt der innere Friede der Gesellschaft. Folgt daraus, daß, wer die Macht hat, die Straße zu mobilisieren und die Öffentlichkeit einzuschüchtern, die Freiheit aller beschränken darf?Der freiheitliche Staat stößt an die Grenzen seiner Möglichkeiten, wenn er das Heilige schützen soll. Eben deshalb ist es angebracht, diesen Grenzen nachzugehen. Im europäischen Verfassungsstaat verlaufen sie anders als in der Rechtswelt des Islam. Der Zündstoff, der sich wegen dieses Unterschiedes anhäuft, zwingt dazu, das Verhältnis des Verfassungsstaates zum Phänomen der Blasphemie neu zu überdenken. Diese Rückbesinnung führt zu den Fundamenten, auf denen die Kultur des Westens, in ihr sein Rechtssystem, baut.
