Philipp Molsberger befasst sich mit der Entwicklung des Subsidiaritätsprinzips im Europarecht. Drehpunkt der Betrachtungen ist der im Oktober 2004 unterzeichnete Vertrag über eine Verfassung für Europa. Zunächst wird untersucht, ob das Prinzip bereits vor seiner Verankerung in Art. 5 Abs. 2 EGV inhaltliche Niederlegungen in europäischen Rechtsquellen gefunden hatte. Dies wird im Wesentlichen verneint. Nach einer näheren Betrachtung des in Art. 5 Abs. 2 EGV verorteten Subsidiaritätsprinzips erfolgt sodann eine Darstellung des Entstehungsprozesses des Verfassungsvertrags, von den ersten Denkanstößen über die Beratungen im Konvent zur Zukunft Europas bis hin zu den Debatten in der Regierungskonferenz. Auch wird der Blick auf in jener Zeit entstandene alternative Verfassungsentwürfe gelenkt. Der Autor befasst sich dann mit den subsidiaritätsrelevanten Bestimmungen des Verfassungsvertrags, zuvörderst mit dessen Art. I-11 Abs. 3 sowie dem Subsidiaritätsprotokoll. Es zeigt sich, dass der Verfassungsvertrag weniger eine Neudefinition der Subsidiarität wagen will, sondern im Schwerpunkt auf ein prozedurales Schutzkonzept setzt. Intensiv werden daher die gewählten Mechanismen zur Gewährleistung des Subsidiaritätsprinzips beleuchtet. Deutlich wird, dass eine effektive Gewährleistung des Prinzips nur möglich ist, wenn dieses strikt als Rechtsprinzip verstanden wird und Wissenschaft wie Praxis einen allzu tiefen Rückgriff auf seine mannigfaltigen Wurzeln vermeiden.Ausgezeichnet mit dem Preis der Reinhold- und -Maria-Teufel-Stiftung für hervorragende wissenschaftliche Leistungen 2008.This study deals with the principle of subsidiarity in European law. Pivotal point is the Treaty establishing a Constitution for Europe signed in Rome in October 2004, though not ratified in all member States. In chapter 1 of the book the author first examines the question whether the principle of subsidiarity had already been implicitly embodied in earlier European legislation. The author's answer is essentially in the negative. The author then comments on the principle of subsidiarity as laid down in Article 5, paragraph 2, of the EC Treaty. Chapter 2 centres on the discussion on a better implementation of this principle during the negotiations on the Rome Treaty of 2004. Alternative drafts of a constitution for Europe are also discussed. Chapter 3 deals with the provisions of the Treaty of 2004 concerning subsidiarity, especially Article I-11, paragraph 3, thereof and the Protocol on the application of the principles of subsidiarity and proportionality. According to the author, the Treaty aims less at a new definition of subsidiarity as a principle of law, but focuses rather on a concept of procedural protection. Moreover, the principle of subsidiarity is effectively guaranteed only if it is strictly interpreted as a principle of law, leaving aside the manifold sources of subsidiarity in the history of ideas.
